MAPEOTOUR is a travel agency & online booking platform for experiences/products and intermediating bookings for accommodation, activities, circuits, transport, tours…

01- Acceptance of terms and conditions – By submitting your data to Mapeotour, you agree to these “Owner policies” (the “Agreement”), to which you are legally bound by this Agreement, the Terms, Privacy & Cookies policies which are also available on the website and mentioned here for reference. You must be 18 or older or be authorized to enter into this contract under Portuguese law. Each person submitting an owner request agrees to operate as a Owner of Mapeotour (hereinafter referred to as “OM”). OM accepts that the breach of any of the conditions set out in “Owners policies” is understood as a breach of this agreement. Once the request has been submitted, this agreement will constitute the Effective Agreement between OM and MAPEOTOUR, a travel agency & online booking platform duly constituted in accordance with the laws of Portugal with registered office at 151 Caminho do Vidro, 4950-778 Monção, and registered with Turismo de Portugal, with the number RNAVT 8377 and the associated NIF 245,575,286. To become an authorized owner of Mapeotour, the owner agrees to these policies. If you do not accept these policies, you cannot be an owner of Mapeotour or submit the request for this website.

02- Term/Renewal/Termination of the Agreement – 02.01- The agreement is accepted for a period of 12 months. Except in cases of termination by OM or MAPEOTOUR, the agreement will be valid after registration by OM & after validation by MAPEOTOUR. To keep the account active as an “owner”, in the first 3 weeks each owner must put at least one experience/product up for sale (see “sustainable tourism” page). 02.02- OM has the right not to renew its owner relationship with MAPEOTOUR annually, informing in writing one month before the end of the same. MAPEOTOUR may not renew this agreement if OM has not acted as described in these policies, due to intentional violations. If MAPEOTOUR does not wish to renew this agreement with OM, there will be written notice, up to 30 days before the end. All amounts due will be paid to OM within the stipulated deadlines by Bank Transfer. 02.03- OM and MAPEOTOUR may terminate this agreement before the scheduled date, whenever they so wish, and there will be written notice to the other party 30 days in advance. Termination by OM is free and by MAPEOTOUR must be based on the violation of these policies. 02.04- Each owner need to have at least 50% of experiences/products verified as “Sustainable”. We understand that some owners can need to promote experiences/products from another tourmaker to complete 50%. You can choose anyone and promote on your page. Your receive commission as an affilliate, subscribe and earn extra incomes. If you submit links to your own experiences/products, your earnings will accumulate! 02.05- During the first 12 months, owner has up to 6 months to achieve a minimum of 3 paid bookings, otherwise the contract will be terminated and the commissions due to owner will be paid. In the following months, you have up to 3 months. When renewing the contract, owner will always have up to 3 months to obtain a minimum of 3 paid bookings. If the contract is terminated by one of the parties, the owner will have to start from scratch if they re-register for the program and owner has not committed any previous infraction. Without the minimum bookings for the mentioned period and/or without having your own product for sale, the account will become a “guest” account, your experiences/products will be suspended and your guests will no longer be associated to your account. 03- Change of Terms and Conditions – MAPEOTOUR may modify the terms of this agreement, or any part thereof, by announcing and notifying such changes in writing to owners by email, or by any other means permitted by applicable law. The changes thus introduced shall take effect from the dates indicated in the respective notification, but not earlier than four (4) weeks after notification, unless the law provides otherwise. If OM does not agree to any of the modifications provided for above, it may terminate this agreement, doing so in writing, as provided for in the previous point.

04- Company OR businessman/entrepreneur person – OM agrees that he/she is not an employee or representative of MAPEOTOUR and that the agreement does not create any employment relationship between the OM and MAPEOTOUR. The OM acts as a company or businessman/entrepreneur person in relation to the activities covered by the agreement. Nothing contained in these policies may be construed as an employment relationship, franchise or other relationship of dependency between OM and MAPEOTOUR, with OM waiving any claim to the contrary. OM agrees not to use the MAPEOTOUR name, service marks or other intellectual property rights owned or licensed by MAPEOTOUR in writing and that such authorization shall constitute a limited authorization. OM agrees not to: (1) take any action that infringes these rights or compromises the name, reputation, brands and goodwill of MAPEOTOUR or its owners/affiliates; (2) use any trademarks or service marks that are similar to MAPEOTOUR‘s trademarks or service marks; or (3) promote, sell or use goods or services produced by third parties under the well-known name, reputation and/or brands of MAPEOTOUR or in false association with them. The OM agrees that he/she will be responsible for all expenses relating to the formalities necessary to establish an independent business in his/her capacity as OM, as well as those relating to the respective operations. As such, MAPEOTOUR has not required and will not require any efforts from you in terms of work, time or money in your development as an OM, nor has it agreed or will it agree to compensate you for the time spent and/or expenses incurred by you in the operation of your work as an OM.
OM agrees to satisfy all legal and tax requirements and to comply with all applicable regulations, laws and/or codes when carrying out any activities authorized under this agreement, including consumer protection laws and regulations. Furthermore, OM agrees not to engage in any actions that may compromise the reputation of MAPEOTOUR or OM or harm the good name associated with MAPEOTOUR and its trademarks owned by it. OM agrees to present proof of compliance with the obligations in question, should MAPEOTOUR request it at any time.

05- Owner Page and experiences/products (for owners who have own experiences/products to sell) – The page with owner experiences/products (Ex: mapeotour.com/tourmaker/mapeotour), will have MAPEOTOUR LOGO as the profile picture and owner’s BANNER with his/her region photo on the page, which will be placed by owner on his/her page only from instant image gallery (not own pictures). Your page contain brand name of experiences/products (Ex: mapeotour.com/tourmaker/mapeotour). The “store page” is to sell only OWN products, tailor-made to guests (Ex: mapeotour.com/store/mapeotour). For owner’s product(s), you can only place one main image/photo and 3 images/photos in the gallery added by owner (from your media gallery or from instant image). For each product, description and image/photo are authored by owner, with product being approved or not by the Mapeoteam. Each owner can have up to a maximum of X products on their page (Check your plan). Products normally are hidden, just visible when sending link to specific guest(s)!

06- Prices, information and reviews of products – The prices shown on our platform include VAT at the legal rate for products. After the owner/guest requests an enquiry via TAILOR MADE form on experience page, MAPEOTOUR confirms the final price per person, availability, as well as booking conditions for this experience/product. MAPEOTOUR is only bound by information exchanged in writing via email, WhatsApp or B2C account messages with participating OWNERS / GUESTS. 06.01- Prices of experiences/products are defined by Mapeotour (BY MAPEOTEAM) and/or by owner (BY OWNERTEAM). 06.02- Information on experiences/products displayed on the platform is written by Mapeotour (BY MAPEOTEAM) or by owner (BY OWNERTEAM). 06.03- The average rating for each experience/product or owner page must be equal to or greater than 4****. If you are a minor, Mapeotour or Owner may have experience/product or page suspended on the platform (analyzed on a case-by-case basis by Mapeotour).

08- Bookings / Cancellations – 08.01 – BookingsMAPEOTOUR is not an instant booking platform (except for experiences/products marked with “INSTANT BOOKING”, booking and seats confirmed immediately). All price and availability information requires validation by email after information/booking request by guests (except experiences/products marked with “INSTANT BOOKING”). Guests accepts that he/she will only form his/her will to book based on the final information received by email. After guests requests information, MAPEOTOUR and/or owners will confirm availability and price of experience/product for desired period with MAPEOTOUR and/or owner (when necessary) and, if a booking is requested, will send the payment details and subsequent confirmation of booking by email. Confirmation of any booking will always imply payment of total amount, by bank transfer or other payment method available on website, to the account indicated on the respective booking voucher sent by MAPEOTOUR to the guest. The booking will only be confirmed after payment by MAPEOTOUR within a maximum period of 24 hours, the period in which the owner blocks seats so that the booking can be made. After receiving payment, MAPEOTOUR will send the owner the necessary guest data as proof of booking BY EMAIL. After booking confirmation, any changes to booking, namely, the desired dates, guest numbers, departure/arrival/check-in or check-out times, any activity or anything related to experience/product, guest contact directly owner on “Dashboard > My bookings”. As well as any request to cancel the confirmed booking, must be requested to MAPEOTOUR via email info@mapeotour.com by  booking himself/herself, and must respect the conditions referred to in the booking & cancellation policies. The booking conditions and information on experience/product availability periods are provided by MAPEOTOUR or its owners and may be changed before confirmed booking. Any change on booking or availability of experience/product, MAPEOTOUR and/or owner will immediately notify guest (“Dashboard > Bookings > Approved > Contact details”). 08.02- MAPEOTOUR‘s cancellation policy is simple and has differents possible cancellations. Only one cancellation method is permitted per experience/product. If a change or cancellation of booking is communicated by guest to MAPEOTOUR up to deadline before the start of experience/product date, MAPEOTOUR or owner will not owe any amount for experience/product booked and cancelled within the deadline by guest (dependeing on commission). If any experience/product undergoes a change in cancellation period published on platform, all bookings prior to modification must comply with the previous cancellation policy defined by MAPEOTOUR and its owners. Only new bookings will have the new cancellation deadline. If guest does not attend the Departure/Arrival or Check-in of booked experience/product, booking will be considered cancelled and there will be no right to any refund from MAPEOTOUR or any of its owners. The specifics relating to the cancellation policy practiced outside the scope provided for in the previous paragraphs will be informed in an initial email, in response to the request for information or booking. It is the guest’s responsibility to be aware and informed of the cancellation rules, and MAPEOTOUR or its owners will not be responsible for guest not reading them. Some experiences/products have their own cancellation policies. In these cases, the cancellation policies practiced by these products are called “Tailor-made”, and are communicated by email to guest in response to the request for information or booking.

09- Availability calendar – Completing the booking form does not imply confirmation. Dates requested on booking request will be confirmed by MAPEOTOUR before the data is sent to guest to confirm booking. Availability of indicated dates on experience/product calendar may not be 100% up to date, therefore, MAPEOTOUR excludes any liability resulting from this fact (except experiences/products marked with “INSTANT BOOKING”).

10- Owner confirmation B2C: Each booking request is available on your dashboard and you immediately receive an email for each order. 10.01- Bookings for experiences on your tourmaker page (Ex: mapeotour.com/tourmaker/mapeotour) are divided into 4 categories: 1- PENDING – Experience pending owner confirmation; 2- APPROVED – Experience approved by owner and paid by guest; 3- CANCELLED – Experience cancelled by guest, by Mapeotour or by owner; 4- EXPIRED – Experience confirmed by owner and not payed by guest after 24h (guest need to book again). 10.02- Bookings for products on your store page (Ex: mapeotour.com/store/mapeotour) are divided into 3 categories: 1- IN STOCK – Product available to order; 2- ON BACKORDER – Custumized product need to be confirm by enquiry; 3- OUT OF STOCK – Waiting list to send. And 3 categories to be processed: 1- PROCESSING – When guest make the order; 2- COMPLETED – When you have STOCK and accept the order; 3- CANCEL REQUEST – When your product is OUT OF STOCK and you update status. We are not an automatic platform (except for INSTANT BOOKING), you can receive bookings and update your stock without any obligation with guest (Mapeotour is not responsible for owners not updating their stock).

11- How to promote / advertise experiences – (PRODUCT BY non-commissionable products) – All experiences present on our platform can be promoted/advertised through any means you deem appropriate, whether local, regional or national. If you have a showcase / display / vehicle / etc … you can post MAPEOTOUR experience. You can use our images with HTML code or simply send your links by email, messenger, whatsapp…(first, BECOME AFFILIATE, see on your dashboard). All PAID international means of communication are not the best way for each country economy, aiming at the development of the national economy and the company / businessman / entrepreneur person. You can use your social media accounts like Facebook, Instagram, Messenger, WhatsApp, etc… as long as there is no so-called “PAID Advertising” or “Sponsored” or other paid publicities terms. Invest more in local, regional or national partnerships 🙂

12- Liability for damages – MAPEOTOUR‘s responsibility is limited to the procedures relating to the booking process. MAPEOTOUR is not responsible for any incident that occurs during experiences or products, material damage or any other damage caused by guest. MAPEOTOUR does not assume any responsibility or intervention in the resolution of disputes between owners and guests, resulting from experiences or products conditions, services provided, previously assumed commitments, events resulting from natural causes or others that limit or condition the realization of booked experience/product. MAPEOTOUR does not offer any conflict mediation services between owners and guests beyond the scope of booking.

13- Booking of experiences/products by Owner or guests associated with him/her as “Tourmaker” –  When OM is LOGOUT, you can register new guests through SIGN IN > REGISTER “TOURMAKER NAME > write your tourmaker name” and receive commissions from future bookings, being considered the guest’s “Tourmaker”! MAPEOTOUR sends a report of all bookings and commissions by the 5th of each month. Products from owners, we promote some local/regional/national products, no affiliate commissions (only Mapeotour % fee). For experiences, you earn commission for each booking (including on your own experiences). You need to agree to affiliates conditions and check your commissions on affiliate dashboard.

14- Conditions for Payment Commissions on experiences to Owner – OM must have a minimum of €150 to be able to obtain their commissions or they are transferred to the following month(s) until a minimum of €150 is reached (or we send in December, after December 15th, the total commissions by bank transfer or coupons code on your account, at owner’s request). OM must send all payment requests (invoice-receipt, invoice or isolated act), without fail, within 5 working days after receiving the total commissions amount sent by MAPEOTOUR. If there is no response by email from the OM, MAPEOTOUR will transfer the payment and total commissions to the next month (up to a maximum value of €5,000).

15- Specifities – Festive dates are understood to be those corresponding to municipal, regional and national holidays, any long weekends or long weekends resulting therefrom, New Year’s Eve, Christmas season, Easter, Carnival… Only the descriptions presented in the advertisement for each experience/product are made available by the description to which it refers. It is the guest’s responsibility to be informed about experience/product they have just booked. For cancellation purposes, the cancellation policies established by the owner at the time of booking or present on their page apply.

17- Ownership of information and right to confidentiality – MAPEOTOUR is the owner of a set of confidential information and trade secrets related to its products. OM confirm and agree that all information on the platform will remain the property of MAPEOTOUR, and to the extent that you are granted access to use the same during this agreement, you will only use this platform within the scope and for the purposes permitted by the agreement. OM will not transfer or disclose the platform to third parties, including other OMs, affiliates or guests, except in strict compliance with the Terms and Conditions of the agreement, without prior written authorization from MAPEOTOURAfter termination or non-renewal of the agreement, OM will no longer have access to the platform. OM acknowledges and agrees that any breach of this clause will cause irreparable damage to MAPEOTOUR, authorizing us to take legal action, especially on a preventive or precautionary basis. All confidentiality obligations regarding data of MAPEOTOUR, its affiliates & guests, provided for in this clause, remain in force after termination of the agreement for a period of 5 (five) years. Any breach of these terms will imply payment by the Owner of an amount of compensation to be calculated in proportion to the damages or losses, including consequential damages and loss of profits, resulting from the non-compliance or defective compliance with the confidentiality obligations that were incumbent upon him as OM, without prejudice to any criminal liability that he may incur in the event of breach of this same obligation, under the terms of the applicable Portuguese Legislation.

18- Businessman/Entrepreneur or Company – OM agrees that he/she is not an employee of MAPEOTOUR and that the agreement does not create any employment relationship between OM and MAPEOTOUR. The OM acts as an businessman/entrepreneur person or company in relation to the activities covered by the agreement. Nothing contained in these terms and conditions may be construed as an employment relationship, franchise or other relationship of dependency between OM and MAPEOTOUR, with OM waiving any claim to the contrary. OM agrees not to use the MAPEOTOUR name, service marks or other intellectual property rights owned or licensed by MAPEOTOUR in writing and that such authorization shall constitute a limited authorization. OM agrees that he/she will be responsible for all expenses relating to the formalities necessary for establishing an independent business in his/her capacity as OM, as well as those relating to the respective operations. As such, MAPEOTOUR has not required and will not require any efforts on your part in terms of work, time or money in your development as a OM, nor has it agreed or will it agree to compensate you for the time spent and/or expenses incurred by you in the operation of your work as a OM. OM agrees to satisfy all legal and tax requirements and to comply with all applicable regulations, laws and/or codes when carrying out any activities authorized under this Agreement, including consumer protection laws and regulations. Furthermore, OM agrees not to engage in any actions that may compromise the reputation of MAPEOTOUR or OM or harm the good name associated with MAPEOTOUR and its trademarks owned by it. OM agrees to provide evidence of compliance with the obligations in question, should MAPEOTOUR request it at any time. 

19- Scope of appointment and benefits – MAPEOTOUR grants the entrepreneur/worker/company, by appointing him/her OM, and provided that he/she complies with the Terms and Conditions of the Agreement, the right to support and motivate other people to join MAPEOTOUR in accordance with the rules of this agreement.

20- Use of name and image – OM authorizes MAPEOTOUR to obtain photographs, videos and other recorded content containing the OM product, so that it can be used in various media, such as websites / blogs / social networks / local, regional or national collaborations. OM allows the contents recorded with its product to be used by MAPEOTOUR for any legal purpose, including their use on the internet (WORLD WIDE WEB), in photographs, in other audiovisual materials, in the brochures and advertisements of MAPEOTOUR, its affiliates & owners, without any retribution or compensation. OM may cancel this authorization by sending written notice by email to MAPEOTOUR to info@mapeotour.com

21- Non-compete agreement –From the moment you are qualified as a owner, without prior and/or written authorization from MAPEOTOUR, OM must not initiate or execute any experiences/products or services, whether directly or indirectly, that may be considered as competitors of ours or similar to MAPEOTOUR‘s experiences/products, and its brands, whether on its own behalf or on behalf of any other person or company using or taking advantage of any confidential information belonging to MAPEOTOUR, its affiliates, owners or guests thereof. OM acknowledges and agrees that any breach of this clause will cause irreparable damage to MAPEOTOUR, authorizing us to take legal action, especially on a preventive or precautionary basis. In case of dispute, the applicable law is that of the Portuguese Republic.

22- APPLICABLE LAW – Any dispute relating to its interpretation and/or execution is subject to the jurisdiction of the Portuguese courts. In the event of a dispute between MAPEOTOUR and a OM, the applicable law is that of the Portuguese Republic. In the event of a dispute, the consumer may resort to an Alternative Consumer Dispute Resolution Entity. More information on the Consumer Portal www.consumidor.gov.pt  ( Law nº144/2015 )
